Why it works

The automatic stay: how one filing stops every collector

The moment a bankruptcy case is filed, federal law puts an automatic stay in place. It orders creditors to stop garnishing, levying, suing, repossessing and calling. Most collectors stop the same day they learn about the case. A few keep going by mistake, and we deal with them directly.

Emergency filings

When a sale date or the next paycheck is days away, we can file a short petition first and complete the rest of the paperwork within the court's deadline.

Fees you know first

Flat fees start at $1,200 plus the court filing fee, with payment plans. You get the number in writing before you hire us.

How it works here

Filing in Los Angeles: court, timeline and what to bring

Which court hears your case

Bankruptcy cases from Beverly Hills and most of Los Angeles County are filed in the U.S. Bankruptcy Court, Central District of California, Los Angeles Division. The court is in the Roybal Federal Building at 255 East Temple Street downtown. We file electronically, so you do not need to go to the courthouse to start your case.

How long it takes

Collections stop when we file. About a month later you attend the 341 meeting of creditors with a trustee. In a typical Chapter 7, the discharge comes a few months after that. A Chapter 13 plan runs 3 to 5 years. We give you a timeline for your own case at the consultation.

What it costs

Our flat fees start at $1,200 plus the court filing fee, and payment plans are available. The fee goes up with the chapter you file and how complex the case is, such as a business, a house with equity or tax debt.

What to bring to your consultation

  • Any garnishment order, levy notice, lawsuit papers or foreclosure notice
  • Your last six months of pay stubs
  • Your last two tax returns
  • A list of your debts, or recent statements
  • Your most recent bank statements

How our bankruptcy service helps with each problem

Stop Wage Garnishment

A garnishment takes part of every paycheck until the debt is paid. Filing bankruptcy orders it to stop, and we notify your employer once the case is filed. Money taken in the last 90 days can sometimes be recovered. Read what to do now on our stop wage garnishment in Beverly Hills page.

Stop Foreclosure

If your lender has set a trustee's sale date, filing before that date stops the sale. Chapter 13 then lets you catch up the missed payments over up to five years while you stay in your home. Do not wait until the day before. Learn the steps on our stop foreclosure in Beverly Hills page.

Stop Bank Levy

A levy can freeze your account with no warning, leaving you unable to pay rent. Filing bankruptcy stops new levies. Funds that are exempt, or that were taken shortly before filing, may be returned. See how on our stop bank levy in Beverly Hills page.

Stop Creditor Lawsuits

Being sued on a credit card or loan usually leads to a judgment, then a garnishment or levy. Filing bankruptcy pauses the lawsuit, and a discharge can wipe out the debt behind it. Bring the court papers so we can check your answer deadline. Read more on our stop creditor lawsuits in Beverly Hills page.

Stop Creditor Harassment

Once your case is filed, creditors must stop calling, writing and suing you. Before that, you can tell collectors to contact our office instead of you. If a collector keeps calling after filing, we put it on notice. Learn more on our stop creditor harassment in Beverly Hills page.

Credit Card Debt Relief

Credit card balances are usually wiped out in Chapter 7 or paid back at a reduced amount in Chapter 13. We list every card and check for large recent charges or cash advances that a creditor might question. Find out more on our credit card debt relief in Beverly Hills page.

Medical Debt Relief

Hospital, doctor and ambulance bills are unsecured debts that bankruptcy can usually discharge. Many medical bills end up with collection agencies under new names, so we track down every one. Read how it works on our medical debt relief in Beverly Hills page.

Payday Loan Debt Relief

Payday and online installment loans often pull money straight from your bank account. We help you stop those withdrawals and include the loans in your case. Loans taken right before filing need care, so tell us about them. Learn more on our payday loan debt relief in Beverly Hills page.

Car Repossession Help

If your car was just repossessed or the lender is about to take it, filing bankruptcy can stop the sale and may get the car back. Chapter 13 can also lower the payment on some car loans. Act fast, because repossessed cars are sold quickly. See our car repossession help in Beverly Hills page.

Reaffirmation Agreements

To keep a financed car after Chapter 7, the lender may ask you to sign a reaffirmation agreement. Signing means you owe the loan again, even after your discharge. We review the terms and tell you whether it fits your budget. Read more on our reaffirmation agreements in Beverly Hills page.

Student Loan Discharge (Undue Hardship)

Student loans are not wiped out automatically. You must show undue hardship in a separate lawsuit inside your bankruptcy. We review your income, loan type and payment history to see whether a claim is worth bringing. Learn more on our student loan discharge in Beverly Hills page.

HOA Debt and Liens

Unpaid HOA dues can turn into a lien and even a foreclosure. Bankruptcy stops HOA collection, and Chapter 13 can repay what is past due over time. Dues that come due after you file are still owed. See our HOA debt and liens in Beverly Hills page.

Rebuilding Credit After Bankruptcy

A discharge is a fresh start, not the end of credit. We explain what your credit report should show after the case, how to dispute errors and the steps that help scores recover over time. Read more on our rebuilding credit after bankruptcy in Beverly Hills page.

Questions

Questions about stopping collections

Will filing bankruptcy stop a garnishment right away?

Yes, filing bankruptcy stops a wage garnishment as soon as the case is filed, because of the automatic stay. Your employer may need a copy of the filing notice before payroll changes, so we send it as soon as the case is filed.

Can I get back money the bank already froze?

Sometimes you can get back money a bank froze. If the money is protected by California exemptions, or it was taken shortly before you filed, we can ask for it to be returned. Call quickly, because frozen funds are often sent to the creditor within a few weeks.

Do collectors have to stop calling me?

Yes, collectors must stop calling once your bankruptcy is filed. Before that, you can ask them to contact our office instead. If a creditor keeps calling after filing, keep a record of the calls and tell us.

What if I already have a judgment against me?

A judgment does not stop you from filing. In most cases, the debt behind the judgment can be discharged, and a lien from it can sometimes be removed. Bring the judgment papers to your consultation.

Does a bankruptcy filing stop a foreclosure sale?

Yes, a bankruptcy filed before the sale stops a foreclosure sale. If you had a case dismissed in the past year, the protection can be shorter, so tell us right away and we will file the right motion.
